PART 6 - OFFENCES
Division 1 - Protection of the
profession
Offence to practise medicine,
&c., if unregistered
63. A person who is not a
registered medical practitioner must not -
(a) practise medicine; or
(b) carry out an act that by or
under an Act is required to be carried out by a registered medical
practitioner.
Penalty: Fine not exceeding 100
penalty units and a daily fine not exceeding 10 penalty units.
False claims
64. A person who is not a
registered medical practitioner must not hold himself or herself out, or
allow himself or herself to be held out, as being a registered medical
practitioner or as being in any way authorised or qualified to practise
medicine.
Penalty: Fine not exceeding 50
penalty units and a daily fine not exceeding 2·5 penalty units.
Unauthorised use of certain
titles
65. A person who is not a
registered medical practitioner must not practise a profession or trade
under any one or more of the following titles:
(a) medical practitioner;
(b) registered medical
practitioner;
(c) certified medical
practitioner;
(d) licensed medical
practitioner;
(e) qualified medical
practitioner;
(f) such other title as may be
prescribed.
Penalty: Fine not exceeding 50
penalty units and a daily fine not exceeding 2·5 penalty units.
Advertising offences
66. (1) A person must not advertise
a medical practice or medical services in a manner that -
(a) is or is intended to be false
or misleading; or
(b) offers a discount, gift or
other inducement to attract patients; or
(c) refers to or cites actual or
purported testimonials; or
(d) unfavourably compares another
medical practice or other medical services with that medical practice
or those medical services.
Penalty: (a) in the case of a
body corporate - a fine not exceeding 50 penalty units; or
(b) in any other case - a fine
not exceeding 25 penalty units.
(2) A person who, in good faith,
publishes or prints an advertisement that contravenes subsection (1) on
behalf of another person is not guilty of an offence under that
subsection.
